Permitless carry In Florida is legal. However, it’s easy to qualify for a Concealed Weapons License (CWL). And having a permit Includes many benefits over Permitless Carry.
Here is the good news. Possession of a Florida CWL gives you several very important benefits over Permitless carry.
A. Florida has Permitless Carry. But by law, an individual must be able to qualify for a Concealed Weapons License anyway, before they can legally carry without a permit.
B. (F.S. § 790.25(5) and F.S. § 790.115(2)(a)(3)) You cannot drive within 1000 feet of a school and carry your gun without a CWL. In this area, almost anywhere you drive, you are going to pass through a school zone and a school.
C. While Florida’s permitless carry law allows eligible individuals to carry a concealed firearm without a license, the Federal Gun-Free School Zones Act still applies. This act makes it a federal crime to possess a firearm within 1,000 feet of a school, unless you have a state-issued concealed carry license.
Federally Protected School Zones Offer A Potential Trap When Carrying A Firearm Under Florida’s Permit Less Statute
Even though Florida has Permit Less Carry, without a valid Florida Concealed Weapons License, you are still subject to the Federal Gun Free School Zones Act.
Imagine having to pull your car over and stop on the side of the road. You have to take your gun off, unload it, and put it in a locked case. Then you have to store it out of reach. You have to do that every time, before you can legally drive through a school zone.
After you pass through the school zone and get more than 1,000′ from the school, you’ll have to stop your car, unpack your gun, load it, and holster it, before you continue on your way!
Get caught driving armed without a Florida CWL through a school zone and you could find yourself sentenced to a stint in a Federal Prison! , Same for even being within 1000′ of a school!
A. Many lawyers agree that if you get into an armed confrontation or a gunfight, things will look better for you when you get to court, if you have a CWL.
B. You must have a state issued CWL to carry in the 37 states that have reciprocity with Florida.
C. You can legally drive through a school zone while carrying your firearm in your holster.
D. There are numerous other good reasons, but these are more than sufficient.
E. Therefore, it is highly recommended that everyone get a Florida Concealed Weapons License Vs. Permit Less Carry.
